Jurisdiction

Deputy State Attorney - Representative of the Republic of Serbia before the European Court of Human Rights, in accordance with the provisionsof the Law on Legal Advocacy and provisionsRulebook on internal organization and systematization of workplaces in the State Attorney's Office, performs the following tasks:

  • manages the Department of the State Attorney's Office for the representation of the Republic of Serbia before the European Court of Human Rights (hereinafter:  European Court), plans, directs and supervises the work of the Department;
  • represents the Republic of Serbia before the European Court in accordance with the Convention for the Protection of Human Rights and Fundamental Freedoms (hereinafter: the Convention) and additional Protocols to the Convention;
  • carries out communication between the Republic of Serbia and the European Court;
  • cooperates with competent domestic authorities in order to collect information related to the preparation of the defense of the Republic of Serbia before the European Court;
  • decides on the referral of the request to the Grand Chamber of the European Court;
  • decides in which cases the Republic of Serbia will intervene in the proceedings before the European Court;
  • enters into written amicable settlements (with the prior consent of the authorities whose acts led to proceedings before the European Court);
  • makes unilateral declarations;
  • represents the Republic of Serbia in the bodies of the Council of Europe of importance for the work of the European Court and participates in the meetings of the working bodies of the Council of Europe;
  • takes care of the execution of judgments and decisions of the European Court (taking individual and general measures according to the judgments/decisions of the European Court, i.e. taking care of timely payment of damages and up-to-date delivery of Action Plans and Action Reports for the Committee of Ministers of the Council of Europe);
  • communicates with competent domestic authorities and the Committee of Ministers regarding the execution of judgments;
  • represents the Republic of Serbia at the meetings of the Committee of Ministers of the Council of Europe in connection with the execution of judgments of the European Court;
  • monitors and analyzes the practice of the European Court in order to harmonize national legislation and practice with the Convention and Protocols to the Convention;
  • undertakes preventive measures in order to raise awareness of the need to respect human rights guaranteed by the Convention and the Protocols attached to the Convention;
  • participates in seminars and conferences related to human rights;
  • publishes reports related to the European Court;
  • prepares reports on the work of representatives;
  • performs other duties as ordered by the Ombudsman.
